PM Gillani not an honest man: SC

ISLAMABAD: The Supreme Court Tuesday formed lager bench giving the government six options in NRO implementation case.

An SC bench headed by Justice Asif Saeed Khosa issued its verdict in NRO implementation case. it said that a dishonest man could not become member of the parliament.

The court observed that the prime minister might be declared disqualified.

The SC hinted that it might form a commission to look into whether Gilani could be declared illegal.

The bench has given six options to proceed with the case while the court recommended the case to the chief justice to form a larger bench to hear the case on January 16.

The court said that Prime Minister Yousuf Raza Gilani is not an upright man and he showed loyalty for a political party instead of the Constitution .

‘Prima Facie the prime minister is not an honest man and violated his oath,” the court said.

‘The government is not taking interest to observe the order for the last two years. We knew that the actions we are about to take they may be unpleasant,’ Justice Khosa said.

‘The court has taken oath to defend the Constitution. The prime minister respected the party over the Constitution,’ he said.

‘The president in an interview to Geo News said his government would not implement one part of NRO verdict,’ the court said.

As per Article 189 and 190 all institutions are bound to help the apex court, the order said.

The SC said the government and National Accountability Bureau (NAB) seem uninterested in the case.

The court said that the government has failed to implement the verdict.

Justice Khosa said “the government and NAB are not serious in implementing the orders and had not acted on those for over two years.

“No one cares about the case and orders” he said.

Earlier, a five-member bench of SC headed by Justice Asif Saeed Khosa resumed the hearing of the case.

The court said that it is responsible for implementation of the order.

A five-member special bench headed by Justice Asif Saeed Khan Khosa and comprising Justice Ejaz Afzal Khan, Justice Ijaz Ahmed Chaudhry, Justice Gulzar Ahmed and Justice Muhammad Ather Saeed.

Earlier presenting to the apex court bench a report on the appointment of Adnan Khawaja as Managing Director of the Oil and Gas Development Company Limited (OGDCL), National Accountability Bureau (NAB) Prosecutor General KK Agha said there is no educational criteria set for the appointment of the MD of the OGDCL.

The report states the Secretary Establishment Ismail Qureshi had no knowledge of the sentence meted out to Adnan Khawaja.

Arguing that the appointment satisfied all legal standards, KK Agha contended before the bench that the PM was legally authorized to appoint the OGDCL MD, adding there is no criminality involved in the appointment of Khawaja on part of neither the PM nor the Secretary Establishment.

This is correct that Adnan was ineligible for ten years owing to being sentenced, KK Agha asserted.
